About these terms

These Terms of Service (the “Terms”) apply to your use of danielcnc.com and purchases from DANIEL CNC, LLC (“we,” “us,” or “our”). Our business is located in Louisiana, United States. By using the website you agree to these Terms. If you do not agree, do not use the website or place an order.

Products and product descriptions

We manufacture some products that are 3D printed. Product listings describe the item, material, dimensions, color, intended use, care instructions, and any known limitations as applicable. Because some products are made using 3D-printing processes, minor variations in color, surface finish, layer lines, dimensions, or appearance may occur. We will identify material variations or limitations that are important to the product’s intended use in its listing.

Review the listing and instructions before using a product. Do not use a product for a purpose or in conditions contrary to its listing, instructions, warnings, or applicable law. Product-specific warnings and restrictions shown in a listing are part of the terms of sale for that product.

Defective products: 15-day request period

If you believe a product is defective, contact us or the retailer within 15 calendar days after you receive it. Include your order number, a description of the issue, and clear photos or other information that reasonably helps us evaluate the claim. Do not send a product back unless we provide return instructions.

If we determine the product is defective, you may request a refund or a replacement. We will coordinate the remedy and any return instructions with you. If you choose a replacement we will ship a replacement product at not cost to you. Any refund will ordinarily be sent to the original payment method through the payment process used for the order, subject to the payment provider’s processing procedures. This 15-day process describes our stated defect-request policy and does not limit any rights or remedies that applicable law does not allow us to waive or restrict.

Other returns, cancellations, and custom orders

Order cancellations and all other returns other than defects must go through the retailer you purchased the product from. If you are not satisfied with the remedy offered by the retailer, please contact us.

Customer rules and prohibited use

You agree not to use the website, account, or products for unlawful purposes; to violate another person’s rights; to interfere with the website or its security; or to engage in fraud, harassment, or abusive conduct. You must use each product consistently with its stated intended use, instructions, and warnings, and must not modify, misuse, or use it in a way that is unsafe or unsuitable.

You are responsible for your own use of a product and for ensuring that your intended use is lawful. We are not responsible for illegal use or misuse by a customer, to the extent that the loss results from that use or misuse. Nothing in these Terms excuses us from responsibility that applicable law does not allow us to exclude or limit, including any responsibility relating to a product defect or our own conduct that cannot legally be disclaimed.

Intellectual property and website use

The website’s text, photographs, graphics, logos, and other content are owned by us or used with permission, unless otherwise indicated. You may use the website for personal, lawful informational purposes. You may not copy, modify, distribute, or commercially exploit website content without our written permission, except where applicable law permits it.

Our separate Privacy Policy explains how personal information is collected and used. These Terms do not replace that policy.

Disclaimers and limits of liability

Product descriptions, instructions, and warnings are provided for the products and uses described in the relevant listing. Do not rely on a product for a purpose not stated or supported by its listing. Nothing in this section removes any warranty or other protection that applicable law does not allow us to exclude or limit.

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from website use or a purchase. This limitation does not apply to liability that cannot lawfully be excluded or limited, or to any remedy that applicable law requires us to provide. No statement in these Terms is intended to waive nonwaivable consumer rights or product-related responsibilities.

Disputes and governing law

If you have a concern or dispute about the website, an order, or a product, please contact us and include your order number and a description of the issue. We will try to work with you in good faith to resolve it. Contacting us does not waive either party’s legal rights or prevent a customer from pursuing a remedy available under applicable law.

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules, to the extent that this choice is permitted by applicable law. Any court proceedings must be brought in a court with proper jurisdiction under applicable law.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when the current version took effect. Changes apply prospectively after posting, except where applicable law requires otherwise.

General terms

If a court finds one part of these Terms unenforceable, the remaining parts continue to apply to the extent permitted by law. Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms, together with the policies and product-specific terms expressly referenced here, describe the agreement for your use of the website and purchases from us, subject to any rights that applicable law does not allow us to limit.
